The SigmaZone and Quantum XL names, logos, and all related product and service names, designs, and slogans are trademarks of Digital Computations, Inc. You may not use such marks without our prior written permission.

As a condition of your use of the Service, you agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. You may not use the Service in any manner that could damage, disable, overburden, or impair any server operated by Digital Computations, Inc., or any network connected to such servers, or that could interfere with any other party’s use and enjoyment of the Service.
You may not attempt to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to any server operated by Digital Computations, Inc., whether through hacking, password mining, or any other means. Unsolicited Ideas
Digital Computations, Inc. does not accept or consider unsolicited ideas, suggestions, proposals, or materials relating to products, services, technologies, marketing, or business strategies (“Unsolicited Ideas”), whether submitted through the Service or by any other means of communication.
If you submit Unsolicited Ideas despite this policy, you acknowledge and agree that: (a) such submissions are not confidential or proprietary; (b) Digital Computations, Inc. has no obligation to review, consider, or keep confidential any Unsolicited Ideas; (c) Digital Computations, Inc. may use, disclose, or develop similar ideas independently without any obligation or liability to you; and (d) you are not entitled to any compensation or credit for any use of Unsolicited Ideas by Digital Computations, Inc.

Limitation of Liability
In no event shall Digital Computations, Inc. (DBA SigmaZone.com), nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
In no event shall our total liability to you for all claims arising out of or relating to the Service or these Terms exceed the greater of (a) the amounts paid by you to Digital Computations, Inc. in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).

The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

(DBA SigmaZone.com), its subsidiaries, affiliates, and licensors do not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.
Exclusions
Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.
Dispute Resolution and Binding Arbitration
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
You and Digital Computations, Inc. agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or your use of the Service (collectively, “Disputes”) shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may seek injunctive or other equitable relief in court to protect its intellectual property rights pending the outcome of arbitration. You acknowledge that by agreeing to these Terms, you are waiving the right to a trial by jury or to participate as a plaintiff or class member in any purported class action or representative proceeding.
Arbitration Procedures: The arbitration shall be administered by the American Arbitration Association (“AAA”). If you are an individual acting in your personal capacity and not on behalf of a business entity, the AAA Consumer Arbitration Rules then in effect shall apply. If you are acting on behalf of a business entity, the AAA Commercial Arbitration Rules then in effect shall apply. The arbitration shall be conducted by a single arbitrator in the State of Florida. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
Class Action Waiver: You and Digital Computations, Inc. each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a Dispute proceeds in court rather than through arbitration, both parties waive any right to a jury trial.
Small Claims Exception: Notwithstanding the foregoing, either party may bring an individual action in small claims court if the Dispute qualifies for such court’s jurisdiction.
Opt-Out: You may opt out of this arbitration provision by sending written notice to Digital Computations, Inc. within thirty (30) days of your first use of the Service. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of this arbitration provision. Notices should be sent to: support@sigmazone.com.
Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect by posting the revised Terms on the Service. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
